[PF:165399] US Court Clears Pakistan of Official Support for 26/11

A US jury on Thursday, June 9, 2011 cleared Pakistan-born businessman Tahawwur Hussain Rana of involvement in the 2008 Mumbai siege and in the process also cleared the Government of Pakistan and its intelligence agencies from accusations of support and involvement in the 26/11 terrorist attacks.

The man on trial in a US court Tahawwur Hussain Rana was accused of allowing his immigration business to be used as cover for his friend David Coleman Headley to scout out potential targets in India's financial and entertainment capital before the attacks. The prosecutor's star witness was David Coleman Headley, Rana's old friend from high school in Pakistan. Headley, who has admitted lying to authorities, has been cooperating with prosecutors since his 2009 arrest at a Chicago airport. In a plot that reads like a movie thriller, Headley spent two years casing out Mumbai, even taking boat tours around the city's harbor to identify landing sites for the attackers and befriending Bollywood stars as part of his cover.

Testimony from the trial provides detailed information vital to understanding the intricacies and complexities involved in the planning of the Mumbai attacks. Headley, in his testimony, elaborated in detail how he befriended members of the banned jihadi group LeT and was assisted by some rogue elements. When questioned closely, Headley admitted that top officials of Government of Pakistan and Pakistan intelligence agency did not know about the attacks and were against it.

Actually, claims of official support for the 26/11 plotters were disproven precisely by the fact that Headley and Rana found themselves in the court room. Rather than finding official protection after the attack happened, the 26/11 plotters told Headley to go underground since the Government of Pakistan and ISI officials were furious and were arresting the perpetrators. The Government of Pakistan and its intelligence agencies arrested most of the named individual in testimony, and they are currently under trial in Pakistan on various criminal and terrorism charges.

The claim put forward by Indian government that Pakistan's intelligence agency aided and abetted in the Mumbai attacks turned out to completely mistaken. Just as the British government and its intelligence agency MI6 cannot be blamed in the Cambridge five affair and the US government and its CIA cannot be held responsible for Aldrich Ames, Government of Pakistan and its intelligence agencies also cannot be blamed for the actions of rogues and impostors, many of them having been already discharged from service for prior suspicions.

Now the truth is out in the shape of the facts revealed by the Tahawwur Hussain Rana trial. These facts confirm the statements of US security officials that Pakistan is committed in the fight against terrorism. Only the most hardened RSS-type conspiracy theorist could deny the facts as they have been proven not by an internal Pakistani investigation but by a neutral court of the United States.

It should be remembered that Pakistan is fighting this war on two fronts: Against Al Qaeda and Taliban and against their affiliates in Pakistani society such as LeT, SSP, and other militant groups also. A complete generation after the Soviet invasion of Afghanistan imbibed this warped ideology which was allowed to grow unchecked even by the Western countries as it was used to defeat Soviet Russia in Afghanistan. Over the period of three decades, the jihadist ideology was institutionalized in Pakistani society by the Wahhabi madrassas and the financial backing they received from wealthy Arab states. Unfortunately, the Government of Pakistan lacked the resources to stem its growth and the rise of this jihadi ideology was not given proper consideration even by US till 9/11 attacks. This makes it a very complex war where Pakistan must fight not only the militant groups but at the same time purge the ideology of extremist jihad that has festered in society.

The Government of Pakistan and its intelligence agencies have been instrumental in dismantling the network of terrorist in region, the proof being counted in the thousands of Pakistani troops and intelligence agents who have laid down their lives in the fight against terrorism and continue to do so. This greatest of sacrifices in the war against terrorism has been recognised by US Chairman Joint Chiefs of Staff Admiral Michael G Mullen recently.

Admiral Mullen lauded the sacrifices and efforts of people of Pakistan and its security forces and reassured that security ties will not be allowed to unravel between the two armed forces.

Gen Kayani and Admiral Mullen acknowledged that evolving Pak-US strategic relation was important for the achievement of mutual long term objectives of comprehensive security of both the countries.

The outcome of Rana trial which was carried out in the US courts should clear any remaining misunderstandings and misguided perceptions. The Government of Pakistan and ISI officials had no role in supporting the 26/11 attacks or terrorism more generally.

Pakistan's current foreign debt is almost $57.21 billion (31 December 2010 est.),
As per budget our Revenues are revenues: $25.33 billion Expenditures: $36.24 billion (2010 est.)

Govt can not organize any reform policies as we are suffering as a MAJOR debtor and following the policies of IMF (Cutting Subsidiaries, Oil Price hick etc etc) then Natural Disaster like Flood couple of time before. OR it is just a Financial CRISES? so we can overcome in span of time?

[PF:165397] Syrian Refugees: Horror tales of massacre

The regime of Syrian President Bashar al-Assad doesn't make threats lightly. And as they confronted the uprising in the town of Jisr al-Shughour, government security forces were blunt, according to the medical staff in area's small hospitals and the local Red Crescent outpost there. Saving a wounded protester's life could cost them their own. As a result, private medical clinics closed and doctors in the northern Syrian town's public hospital fled. Of 200 Red Crescent volunteers, only five defied the threats to continue working, including "Abu Taha," a 29- year-old volunteer ambulance driver whose bravery earned him a bullet in the back.

He was shot on the morning of June 5, hours before rights workers say several hundred of the soldiers deployed in the town defected, protecting protesters from other soldiers intent on carrying out their shoot-to-kill orders. Some 120 security personnel were killed that day, although the regime in Damascus denies there was a mutiny and says the deaths were at the hands of "armed gangs" and "terrorists" wearing stolen military uniforms.

The gaps between the two versions are being filled by some of the many Syrian refugees from besieged northern towns including Jisr al-Shughour who have streamed across the nearby Turkish border in recent days and are being housed in several camps. Although Turkish authorities have severely restricted media access to the refugees, accounts are nonetheless trickling in, especially from wounded Syrians like Abu Taha being treated in several hospitals in the southern Turkish city of Antakya. Those who spoke to TIME asked not to be identified by their real names for fear of reprisals against family still in Syria and of angering the Turkish government.

Abu Taha remembers helicopters roaring overhead last Sunday as he scrambled to save the "hundreds" of wounded he saw mowed down in Jisr al-Shughour's public garden. He says up to 10,000 people were gathered in the space, after burying a young man, Basil al-Masry, who was killed by security forces the day before. "The garden was packed, we were shoulder to shoulder. Then the bullets started raining down on people from all of the government buildings around the garden," Abu Taha told TIME from his hospital bed in Antakya. "They were shooting from helicopters, using machine guns with 14.5 caliber bullets. Do you know what a bullet like that does to a human body?" Abu Taha does. A day earlier, he says he saw a man with his skull split open by such a bullet in front of the Post Office building adjacent to the garden.

On that Sunday, the killing was indiscriminate and widespread, according to information independently obtained from more than half a dozen Syrians who have recently fled from Jisr al-Shughour into Turkey. The townsfolk scurried along two side streets leading away from the garden, as security forces in the buildings shot into the crowd from above. "I was bending down to pick up a man who'd been shot," Abu Taha says. "The bullet came through my chest. I collapsed on top of him." His colleagues, who were also in Red Crescent uniforms, administered first aid. That's all he remembers. He didn't see any wounded soldiers, only civilians, and doesn't remember travelling to Turkey.

"Samir," 28, says there were signs that something was brewing in Jisr al-Shughour days before Sunday's carnage. He was one of the first to be shot in the garden, he says, and also has no idea how he came to be in a Turkish hospital in this city. His body was riddled with bullet holes; one scraped past the left side of his neck, the other pierced the left side of his chest, above his heart, the third shattered his right forearm, which is now encased in plaster. The father of one and almost too tall for his hospital bed, Samir has severe internal bleeding, and speaks softly with great difficulty, in halting breathless bursts.

He said that there were unfamiliar vehicles without license plates driving around his town, sometimes shooting indiscriminately at buildings and bystanders. The young men of Jisr al-Shughour had set up several unarmed checkpoints around their town to prevent the entry of strangers. But strangers entered, including a bearded man in military uniform who did not speak Arabic and was nabbed by Samir and a group of young men. (Syrian soldiers are not permitted to wear beards.) "I don't know Iranian, I don't have experience with Iranians, but the man didn't speak Arabic," says Samir. "Not a word."

He denies government claims that the mourners gathered in the garden were armed. "If we had weapons, believe me, I would have been the first to use one, but we don't," Samir said. "And besides, what is a hunting rifle going to do against a machine gun, against a tank?" His father, who like almost all of the town's 50,000 residents, has now fled, either to Turkey or in the hills around Jisr al-Shughour, told his son that "honorable soldiers" started defending the people that Sunday, and that many of them were killed. Many of the townsfolk already knew that there had been isolated military defections elsewhere in the country, because some 20 days earlier, the body of a young conscript was returned to his parents in Jisr al-Shughour. He'd been in the shot in the back of the head, Samir said, presumably for failing to shoot at protesters. "We went to bury him, to honor him, the security forces prevented us." His voice fails as he tears up at the memory. "They didn't let us bury him in an honorable way."

Samir's mother, wife and one-and-a-half year old daughter made it safely into Turkey on the weekend, taking illegal routes and avoiding main roads which many refugees say are patrolled by the military and armed thugs known as shabbiha. Abu Taha's immediate family is too afraid to take the trek, he said, and like many others is hiding out in the hills between Jisr al-Shughour and the Turkish border. "They're very, very scared," he said. He pauses for a moment, saying his nine-month-old son is out there in the hills, forced to live in the open. "You know, my father – God rest his soul – used to tell us, 'whoever speaks about politics will be made to disappear from the face of the Earth'," he says wistfully. His father was of a generation that witnessed an earlier atrocity in Jisr al-Shughour in the 1980s, committed by current Syrian President Bashar al-Assad's late father, Hafez. At the time, the town was a stronghold for the Muslim Brotherhood, and today remains a conservative Sunni Muslim bastion. Nobody knows how many people were killed back then, although now many refugees independently interviewed speak of a mass grave at the sugar refinery that they all knew about, but were too scared to reveal. "What is happening in Syria now has been a part of the Syrian regime for a long time; the torture, the removing of fingernails, the scalding of skin, it happened but it was hidden," Abu Taha says. "We all knew about it, but now, thank God, now everyone can see the true face of this regime."

[PF:165396] Wikileakes: Benazir Bhutto has US support

KARACHI: According to whistleblower Wikileaks, a cable of the US Ambassador dated January 28, 2008 stated that Asif Ali Zardari described the US as "our safety blanket". He recounted how Benazir Bhutto had returned despite the threats against her because of support and clearance from the US.

Zardari acknowledged that he had believed that the closer he got to General Kayani, the more Kayani would be weakened.

Wikileaks spilled the beans from one of the statements made by Khyber Pakthunkhwa Chief Minister, Amir Haider Khan Hoti. US Counsel Principal Officer in Peshawar Tracy's cable dated April 30, 2009 sent to Washington said that Amir Haider Khan Hoti has appreciated the drone attacks, but he (Hoti) also said that he could never support it in public.

Lahore US Counsel Principal Officer Brian Hunt said that former Governor Punjab, Salman Taseer flayed Shahbaz Sharif's government. In a cable dated December 31, 2008, Brian Hunt wrote that Salman Taseer was of the view that Shahbaz Sharif's government was highly heart burning. "Shahbaz Sharif is hard working, but just like my gardener. Brian Hunt in a memo dated February 7, 2009 wrote that Salman Taseer had nothing to do with the lawyers' long march and he was getting ready to celebrate Basant and would see whether the people give importance to the long march or choose to party for Basant.

Pakistan's current foreign debt is almost $57.21 billion (31 December 2010 est.),
As per budget our Revenues are revenues: $25.33 billion Expenditures: $36.24 billion (2010 est.)

Govt can not organize any reform policies as we are suffering as a MAJOR debtor and following the policies of IMF (Cutting Subsidiaries, Oil Price hick etc etc) then Natural Disaster like Flood couple of time before. OR it is just a Financial CRISES? so we can overcome in span of time?


As being a Pakistanis Do you have Any Preferred Reform in your mind ? like Economic, Industrial, Agri etc etc.

السلام عليكم ورحمة الله وبركاته

قولكم: (من غير الممكن اعتبار ما لم يات في القرآن أو في السنة كمثل ما جاء في القرآن والسنة) من أين لك أنني أدعي (مِثْليَّة) ما جاء في الكتاب والسنة بغيره؟! بل الكتاب والسنة أصل الدلائل الإجمالية التي نحتكم إليها، فدلائل الفقه المتفق عليها بين جماهير الأصوليين الكتاب والسنة والإجماع والقياس، فالإجماع والقياس يستندان في حجيتهما إلى الكتاب والسنة، بل إن حجية السنة تستند من حيث الأصل إلى الكتاب، فرجع أن جميع دلائل الفقه الإجمالية تستند في أصل الاحتجاج بها إلى الكتاب.

والإجماع والقياس إنما هما في حقيقتهما على حد قولك: (تعبير عن رأي المجتهد)، لكن كما ذكرنا في المقال أن الخلاف الفقهي بين الفقهاء إذا تلاشى أو لم يظهر تحول مجموع اجتهادهم إلى دليل إجمالي آخر هو الإجماع، فالإجماع (كاشف) عن حقيقة الحكم في نفس الأمر، لأن الأمة لا تجتمع على ضلالة.

وقولك: (فالشرع شرع والاجتهاد اجتهاد): لولا أن الشرع سمح، وأباح، وتشوف للاجتهاد إذا عُدِم النص ما جاز لأحد أن يجتهد أصلا!! فلا شك أن الاجتهاد مشروع، فالاجتهاد كغيره يستند في وجوده إلى النص الشرعي، ولهذا قلنا أن الاجتهاد بمجمله أو بجنسه من الشرع، أما ما يسبب لك المشكلة فهو آحاده، فآحاد الأقوال الاجتهادية ليست حجة على من يملك ملكة الاجتهاد، فقول المجتهد ليس بحجة على مجتهد آخر، ولا يستطيع آحاد المجتهدين الادعاء أن قوله حجة كالشرع، وهذا ما لم نذكره في المقال، ولا ندعيه، ولا يدعيه من اشتم رائحة العلم الشرعي.

وما ندعيه هنا يشبه إلى حد كبير ما توافق عليه جمهور العلماء من قولهم (القياس حجة شرعية)، فهذا القول يعبر عن مجمل هذا الدليل الإجمالي أو جنسه، فجنس القياس حجة، لا آحاد الأقيسة، ولهذا نَعْدِل عن القياس الأضعف إلى الأقوى إذا توفر.

فقولهم (القياس حجة شرعية) لا يعني عصمة أقوالهم، ولا خروجها عن بشريتها.

أرجو أن تكون قد تبينت الفرق بين جنس الاجتهاد وآحاده.

وأما قولك (والأصل بقاء الأمر على ما هو عليه) لا تعلق له بموضوعنا، فهي قاعدة فقهية تختص بأفعال المكلفين، وليست قاعدة أصولية، فحديثنا أصولي وليس فقهيًا!

وإن سايرتك في استعمالها في هذا الموضع تنزلا فقد ذكرت لك أنه كلما تلاشى الخلاف بين الفقهاء شيئا فشيئا حتى ينعدم اتخذ الحُجِّية من أصل جديد هو الإجماع، وهو مُبَيِّنٌ وكاشف لحكم الشارع، حتى ما لم نقف فيه على نص، ولهذا اعتبرنا أن الإجماع من نقاط التماس بين الشريعة وبين الاجتهاد، وبهذا لم يبقَ الاجتهاد على (أصله)، وإنما (استحال) لحكم شرعي ملزم لجميع المسلمين.

هذا عدا الخلاف الشهير في حجية قول الصحابي، وهذا هو الـمُتَرِّجح عن الكثير من المحققين في هذا الفن، ولا يعني ذلك اعتباره شرعا، بمعنى رفع قوله إلى مصاف النص الشرعي، لكن الحجية لا يشترط لها العصمة كما أشرت في المقل بارك الله فيك.

وبصفة عامة لولا أن الاجتهاد من الشرع ما جاز لمقلد أن يتبع قول عالم شرعي، ولهذا نقول إن التقليد مشروع بشرطه لمن لا يملك القدرة على النظر والاستدلال، لكننا في نفس الوقت لا نحمله على قول عالم أو إمام بعينه، فهذا هو الوجه الآخر لقولنا أن الاجتهاد من الشرع بجنسه لا بآحاده، فتأمل!

مع احترامي وتقديري لك إلا أن من غير الممكن اعتبار ما لم يات في القرآن أو في السنة كمثل ما جاء في القرآن والسنة.

فالشرع شرع والاجتهاد اجتهاد وحسب علمي فإن الصحابة والتابعين وغيرهم لم يقل أحد منهم بحجية رأيه ولم يجعله شرعاً لا.. كما أنه لم يأت عن أحد منهم أنه جعل الاجتهاد جنساً أو عيناً جزءاً من الدين.

والأصل هو بقاء الأمر على ما هو عليه وهو أن الاجتهاد هو تعبير عن فكر أو راي المجتهد ولا يجوز بحال أن نجعله حجة لازمة في حق العباد كنصوص الشريعة من القرآن والسنة..

Chapter: It is disliked for a man to buy what he gave in charity from the one to whom he gave it.

Hadeeth: It was narrated from Ibn 'Umar that 'Umar bin Al-Khaṭṭâb donated a horse (to be ridden in Jihâd) in the cause of Allâh, and he found it offered for sale. He wanted to buy it, and he asked the Messenger of Allâh صلى الله عليه وسلم about that. He said: "Do not buy it; do not take back your charity."

Sahih Muslim, Volume 4, Book of Gifts 24, Chapter 1, No. 4167

 

Category: Business

Chapter: The invalidity of Al-Mulâmasah[1] and Al-Munâbadhah[2] transactions.

Hadeeth: It was narrated from Abû Hurairah that the Messenger of Allâh صلى الله عليه وسلم forbade Mulâmasah and Munâbadhah transactions.

Chapter: Accepting the testimony of one man concerning the crescent moon of Ramaân.

Hadeeth: It was narrated that 'Abdur-Ramân bin Zaid bin Al-Khaṭṭâb addressed the people on the day concerning which there was doubt (as to whether the month had begun) and said: "I sat with the Companions of the Messenger of Allâh صلى الله عليه وسلم and asked them, and they narrated that the Messenger of Allâh صلى الله عليه وسلم said: 'Fast when you see it and perform the rites on that basis. If it is obscured[3], then complete thirty days, and if two witnesses testify then fast and stop fasting."

Chapter: Wearing a brass ring.

Hadeeth: It was narrated that Anas said: "The Messenger of Allâh صلى الله عليه وسلم came out wearing a silver ring. He said: 'Whoever wants to make a ring like this, let him do so, but do not put the same inscription.'"

Sunan An-Nasâ'i, Volume 6, Book of Adornment 48, Chapter 50, No. 5210

 

Category: Virtues

Chapter: The adoption of a middle course (not to go to extremes), and the regularity of one's deeds.

Hadeeth: Narrated 'Āishah رضي الله عنها: The most beloved action to Allāh's Messenger صلى الله عليه وسلم was that whose doer did it continuously and regularly.

Sahih Al-Bukhâri, Volume 8, Book of Ar-Riqāq (Softening of the hearts) 81, Chapter 18, No. 6462

 

Category: Virtues

Chapter: The virtues of 'Umar رضي الله عنه.

Hadeeth: Abû Hurairah said: "I heard the Messenger of Allâh صلى الله عليه وسلم say: 'While I was sleeping, I saw myself at a well by which there was a bucket. I drew as much (water) as Allâh willed from it, then the son of Abû Quâfah (i.e., Abû Bakr A-iddîq) took it and drew a bucket or two with some weakness, may Allâh forgive him. Then it changed into a large bucket, and the son of Al-Khaṭṭâb took it, and I have never seen any leader among the people draw water as vigorously as 'Umar bin Al-Khaṭṭâb; (he drew so much water) that the people drank their fill and then they stayed there for a while.'"

Sahîh Muslim, Volume 6, Book of Virtues of the Companions رضي الله عنهم 44, Chapter 2, No. 6192

 

Category: Hell

Chapter: What has been related about the description of the drink of the inhabitants of the fire.

Hadeeth: Ibn 'Abbās narrated that the Messenger of Allāh صلى الله عليه و سلم recited this Āyah: Have the Taqwā of Allāh as is His due, and do not die except as Muslims.[4] And the Messenger of Allāh صلى الله عليه و سلم said: "If only a drop of Az-Zaqqūm were to drip into the adobe of the world, it would spoil the peoples' livelihood, so how about the person for whom it is his food?"

Jāmi' At-Tirmidhī, volume 4, Book of Description of Hell 37, Chapter 4, No. 2585

[2]    Al-Munâbadhah is an agreement to barter one thing for another without seeing or checking either of them.

[3]    Meaning too cloudy so that you cannot see the new crescent.
