{Kantakji Group}. Add '11885' Interest Bearing Transactions in the US (22)




Assalamu Alaykom Wa Rahmatu Allah
 


إذا اضطُرّ المسلم للحصول على المال ولم يجد من يُقرضُه قرضاً حسناً فلا بأس أن يشتريَ سلعة – كسيارة مثلاً- إلى أجل ثم يبيعها نقداً لطرفٍ ثالثٍ غير البائع، وهذا ما يسمّيه الفقهاء (التورّق) على أن لا يتّخذ ذلك عادةً خروجاً من الخلاف مع من يرى منع هذه الصّورة. فإن باع السلعة للبائع الأول نفسه فهذا بيع (العينة) الذي نهى عنه النبيّ صلى الله عليه وسلم.

If a Muslim is desperate for money and could not find an interest-free loan , he may buy a commodity – a car for instance - on credit sale basis and then sells it cash to a third party other than the seller. This is named by the jurists as Tawarruk. Some scholars see this transaction as a forbidden one, thus, it is preferred not to get used to it, just to avoid disputable issues. Selling the commodity back to the original owner is prohibited. The prophet PBUH named it Al- Einah.

والكيفية السّابقة للتورّق – بالمناسبة- تختلف عمّا يسمى ب (التورّق المصرفيّ المُنظّم ) التي تمارسه بعض البنوك الإسلامية في الشرق – وليس في الولايات المتّحدة-وصورته أن يبيع البنك سلعةً مرابحةً إلى أجلٍ لعميله ثم يتولى بيعها نقداً – عادةً بسعرٍ أقل – لطرفٍ ثالثٍ نيابةً عن العميل ويُسلّمه الثمن، فتكون النّتيجة أن العميل أخذ ثمانيةً نقداً من البنك وهو مدينٌ لذات البنك بعشرةٍ مؤجّلة ! فهذه الصّورة لا تجوز لأنّها إن لم تكن الرّبا بعينه فهي شبيهة الربا

But Tawarruk as described above is different from the (Systematic Banking Tawarruk) in some Islamic banks in the East, which holds that the bank sells a Murabahah- based commodity to its client, then sells it in cash – usually at less price than it has bought- to a third party on behalf of the client , then it hands him the price. The result is that the client has taken from the bank eight in cash while he still owes it for ten on credit! This way goes against Sharia because if it is not usury, it is suspicious to be so.

يجوز العمل عند من يقترضُ بالرّبا لتطوير عمله وسداد ديون شركته إذا كان عمل الشركة مباحاً لقوله تعالى (ومن يكسب إثماً فإنما يكسبه على نفسه).

كمايجوز العمل عند من يُقرضُ غيره بالرّبا متى كان أصل عمل الشركة مباحاً ولم يُباشر الموظّف الإقراض أو المعاونة أو الإشراف عليه

A Muslim can work for the one who borrows with usury to upgrade his work and pay off his business debts, provided that the core business of the company be Sharia compliant one. Allah SWT says, which means in English (If anyone earns sin, he earns it against his own soul). Likewise, A Muslim can work for an interest- moneylender as long as the core business of his company is permissible, providing that the employee does not work in lending or processing or supervising usurious loans.

تجوز المشاركة وغيرها من صِيَغ التمويل مع صاحب المال الحرام المحض كالذي كلّ دخله من الحرام ، أو خالطه الحرام كمن مصدر ماله حلال لكن يُقرضُ ويقترضُ بالرّبا، وسواءً كان الشريك مسلماً أو كافراً، بشرط أن تمارس الشركة عملاً مباحاً. لكن الأولى بالمسلم أن يشارك الصالحين من المسلمين دون غيرهم.


A Muslim can engage in any Islamically acceptable partnership with another person whom his wealth is purely prohibited by Sharia, or the one who has mixed wealth, such as the one whom his source of income is allowed, but lends and borrows with usury, and whether this partner is a Muslim or not, provided that the core business of the new company is lawful.  Nevertheless, a Muslim is advised to partner with the righteous Muslims and not with any body else.

يجوز التعامل مع النوافذ الإسلامية في البنوك الربوية متى كانت المعاملة في ذاتها مشروعةً كالمضاربة والمشاركة والمرابحة وغيرها من طرق التمويل و استوفت شروط صحّتها، ولا يقدح في هذه الإباحة كون أموال البنوك جاءت بطريقةٍ غير مشروعة ، فقد تعامل النبيّ صلى الله عليه وسلم مع مشركي مكّة ويهود المدينة- بل وأكل من طعام اليهود ولحومهم- مع علمه عليه السلام بتعاملهم بالرّبا.

Dealing with the Islamic windows of conventional banks is permissible as long as the very deal is consistent with Sharia like Modharabah or Mosharakahor Morabahah and any other Islamic mode of finance, provided that these modes meet the required conditions. The impermissible source of money these banks might have does not prohibit dealing with them, since the Prophet PBUH transacted with the polytheists of Mecca and Jews in Medina while knowing about them dealing with Riba

وحكم رسوم التقسيط قريبٌ من حكم رسوم إصدار القرض. فمثلاً، تسمح الجامعات للطّلاب دفع الرسوم الدراسية بالتقسيط على مدار الفصل الدراسيّ، وقد تتولّى فعل ذلك بنفسها وقد تُحيل أمر التقسيط لمؤسّسةٍ أخرى تتولى أمر حساب وتخزين معلومات وجمع الرسوم الجامعيّة بمقابلَ تتقاضاه. فإذا كانت رسوم التقسيط مبلغاً ثابتاً (وهي كذلك) حتى وإن كان دورياً فلا يُعدّ من الرّبا، ويُمكن تخريجه على أنّه مقابل الجهد المبذول في تحصيل المال وتوثيق ذلك، كما يمكن تخريجُه بالنّسبة للطالب على أنّه جزءٌ من أصل الدّين. فإذا كانت الرسوم الدراسية 1000 نقداً، والجامعة تأخذ 25 دولار عن كل قسط وتسمح بثلاثة أقساط ، فيمكن أن يُقال أنّ الطالب أمام خيارين: إما 1000 حالّة ، أو 1075 بالتقسيط

: Similar to the aforementioned is the installment fees. For example, universities allow students to pay their tuition fees on installments throughout the semester. They may collect the tuition by themselves or through a collection agency, who saves the data and collect the money for a fee. If the installments duties are fixed sum of money-which is the case- it is then not considered usury, even if it is charged periodically, since it can be taken as service fees. For the student, it could be taken as a part of the loan itself. So, if the total fees are $1000, and the university allows 3 installments and charges $25 for each installment, then it could be said that the student has two options: either $1000 full payment or $1075 installments.

English Translation of Al-Quran

[23].Surah Al-Muminun [The Believers]

Ayat 90. Nay, but Allah have brought them the truth (Islamic Monotheism), and verily, they (disbelievers) are liars.

Ayat 91. No son (or offspring or children) did Allah beget, nor is there any ilah (god) along with Him; (if there had been many gods), behold, each god would have taken away what he had created, and some would have tried to overcome others! Glorified be Allah above all that they attribute to Him! Ayat 92. All-Knower of the unseen and the seen! Exalted be He over all that they associate as partners to Him!

[Tafseer] of ayat 90. We have sent them the Truth: but they indeed practice falsehood! in ayat 91. its clarify that No son did Allah beget, nor is there any god along with Him: (if there were many gods), behold, each god would have taken away what he had created, and some would have lorded it over others! Glory to Allah. (He is free) from the (sort of) things they attribute to Him! The multiplicity of gods is intellectually indefensible, considering the unity of Design and Purpose in His wonderful Universe. Allah knows what is hidden and what is open: too high is He for the partners they attribute to Him! To suppose that Allah has a son or a family or partners or companions is to have a low idea of Allah, Who is high above all such relationships. He is the One True God, and there can be none to compare with Him.    

English Translation of Hadith  

Hazrat Jabir (May Allah be pleased with him) reported: A bedouin came to the Prophet [SAWW](PBUH) and asked him, "O Messenger of Allah [SAWW](PBUH), what are the two imperatives which lead to Jannah or Hell". He [SAWW](PBUH) replied, "He who dies without associating anything with Allah will enter Jannah, and he who dies associating partners with Allah will enter the Fire".

[Muslim Book 01,Chapter 41, Hadith # 168]

Lesson : as mentioned above in Surah Al-Muminun Ayat 92."Exalted be He over all that they associate as partners to Him!" This Hadith also holds promise for a Muslim that being a Muslim and Muwahhid (believer in the Oneness of Allah) he will be at last sent to Jannah. Whether he goes straight to Jannah or after suffering the punishment of his sins in Hell, is a separate issue, but he will not remain in Hell for ever. Eternal punishment in Hell is reserved only for pagans, polytheists, and infidels.
